General Terms and Conditions for all degree programs, certificate programs, and seminars
1.1 These General Terms and Conditions apply to the entire business relationship between the student or seminar participant (hereinafter referred to as the "student") and Cronos Finanz Business School upon conclusion of a contract for a degree program, seminar, or certificate program (hereinafter referred to as the "degree program"). All masculine formulations refer equally to persons of both genders.
1.2 In addition, special terms and conditions apply to individual business relationships that contain deviations from or additions to these General Terms and Conditions; they are agreed upon with the student upon conclusion of a contract. To the extent that the special terms and conditions for individual business relationships or other agreements stipulate otherwise, these differing provisions shall prevail.
2.1 The student is obligated to provide Cronos Finanz Business School with all information and documents relevant to the implementation of the degree program in a timely manner. For the proper processing of business transactions, it is particularly necessary that the student immediately notify Cronos Finanz Business School of any changes to their name and contact details.
2.2 The student must immediately check certificates and other notifications from Cronos Finanz Business School for accuracy and completeness and raise any objections without delay.
3.1 Unless otherwise agreed, for the proper and timely processing of all formalities related to the degree program, it is necessary for the student to provide Cronos Finanz Business School with an email address and check it regularly. For example, schedules, changes, course notes, and important information (e.g., exam results) are generally provided to the student via email.
3.2. Email communication may be unencrypted.
3.3 The student must ensure that the email address is protected from access by unauthorized third parties.
4.1 The study materials provided to students by Cronos Finanz Business School are intended as a supportive resource. They do not release students from their obligation to study literature, attend classroom lectures, and follow current developments in the subject area. In particular, the study materials cannot fully cover possible exam content.
4.2 Students must obtain additional study materials (e.g., legal texts, further reading, and resources) at their own expense.
4.3 Cronos Finanz Business School reserves the right to modify or replace the provided study materials, particularly to update them regularly.
5.1 The study materials provided to students electronically or in print are intended solely for the purpose of study and personal use.
5.2 Unless otherwise agreed or indicated, all rights are held by Cronos Finanz Business School.
5.3 The student undertakes not to disclose or otherwise distribute Cronos Finanz Business School study materials and any course content made available via the extranet or other media to third parties, and not to infringe copyrights. Reproduction is permitted only for the purpose of the student's own studies.
6.1 Notwithstanding the above provisions and the following limitations of liability, Cronos Finanz Business School is fully liable for damages to life, body, and health resulting from a negligent or intentional breach of duty by its legal representatives or vicarious agents, as well as for all damages resulting from intentional or grossly negligent breaches of contract or fraudulent intent by its legal representatives or vicarious agents.
6.2 Cronos Finanz Business School is not liable for damage to property or financial losses due to slight negligence, unless it has breached a material contractual obligation, the fulfillment of which is essential for the proper execution of the contract, the breach of which jeopardizes the achievement of the purpose of the contract, and on whose compliance the student regularly relies (hereinafter "cardinal obligation"). Liability for breach of such a cardinal obligation is limited to the foreseeable damage typical for the contract. This also applies to lost profits and lost savings. Cronos Finanz Business School is not liable for simple negligent breaches of non-essential contractual obligations. The limitations of liability stated under 6.2 also apply to the extent that the liability of Cronos Finanz Business School's legal representatives, senior managers, and other vicarious agents is affected.
6.3 Any further liability of Cronos Finanz Business School is excluded regardless of the legal nature of the asserted claim. To the extent that liability is excluded or limited, this also applies to the personal liability of Cronos Finanz Business School's employees, workers, staff, representatives, and vicarious agents.
6.4 To the extent that the Special Terms and Conditions for individual business relationships or other agreements provide otherwise, these differing provisions shall prevail.
Cronos Finanz Business School is not liable for damages caused by force majeure, riots, war, natural disasters, or other events beyond its control (e.g., strikes, lockouts, traffic disruptions, government orders in Germany or abroad).
If the student has contributed to the occurrence of damages through culpable conduct (e.g., by violating the duty to cooperate listed in Section 2 of these Terms and Conditions), the extent to which Cronos Finanz Business School and the student are liable for damages shall be determined according to the principles of contributory negligence.
9.1 Unless otherwise provided in the Special Terms and Conditions for the respective degree program, the student may terminate the contract for a degree program no later than four weeks before the start of the program.
9.2 Termination must be made in writing. Upon the student's request, Cronos Finanz Business School will confirm receipt of the termination.
9.3 The right of Cronos Finanz Business School and the student to terminate the contract for good cause remains unaffected. Cronos Finanz Business School is particularly entitled to terminate the contract without notice if a) the student is in arrears with the payment of the fee invoiced for the course of study and fails to pay within a period of four weeks despite a written deadline and a threat of possible termination by Cronos Finanz Business School, or b) the student's behavior significantly disrupts the orderly teaching or course of study or the trusting collaboration with fellow students, lecturers, or Cronos Finanz Business School or its employees, despite a written warning and a deadline. Section 323 (2) of the German Civil Code (BGB) applies accordingly.
10.1 Cronos Finanz Business School determines the lecturers and the course and examination schedule for the degree programs at its reasonable discretion.
10.2 Cronos Finanz Business School determines the course and examination dates.
10.3 The location specified means that courses are usually held in-person at this location. Cronos Finanz Business School reserves the right to relocate individual courses or courses in individual subject areas to another location within a reasonable distance or to conduct them online due to regulatory, health, teaching, spatial, or similar requirements. Courses in a program may also be held partially or entirely online if there are pedagogical, didactic, or organizational reasons for doing so and this has been communicated to participants in a timely manner. Online courses in the aforementioned sense are typically conducted as real-time transmissions, allowing contact between lecturers and participants at any time, just as in an in-person event.
10.4 Participants are not entitled to reimbursement of any additional costs incurred.
11.1 Six weeks after receipt of the invoice by the student, the invoice is deemed to have been accepted by the student unless a complaint is raised with Cronos Finanz Business School within this period. Cronos Finanz Business School will specifically indicate on the invoice the possibility of objections within the six-week period.
11.2 The student shall pay Cronos Finanz Business School the remuneration for the degree program as set out in the Special Terms and Conditions.
11.3 The student's payment obligation is not affected by the student not starting the program or failing to attend classes at a later date, unless Cronos Finanz Business School caused the non-attendance through breach of contract.
11.4 Timely payment of the invoiced remuneration for the degree program is a prerequisite for the student's admission to the program. Cronos Finanz Business School is therefore not obligated to admit a student to the program if the student is in arrears with payment of at least 50% of the invoiced fee.
12.1 Changes to these General Terms and Conditions and the Special Terms and Conditions will be communicated to the student in writing.
12.2 If the student has agreed to an electronic communication channel with Cronos Finanz Business School as part of the business relationship (e.g., the intranet, the extranet/myCampus), the changes may also be communicated via this channel if the method of communication allows the student to save or print the changes in a legible form.
12.3 Changes to these General Terms and Conditions are deemed approved if the student does not object in writing or via the agreed electronic method. Cronos Finanz Business School will specifically draw the student's attention to this consequence upon notification. The student must submit the objection to Cronos Finanz Business School within six weeks of notification of the changes.
13.1 There are no ancillary agreements. Ancillary agreements must be in writing.
13.2 Amendments, additions, and the cancellation of this contract must be in writing to be effective. This also applies to any amendment to this written form clause itself.
German law applies to the business relationship between the student and Cronos Finanz Business School.
The place of performance for the academic performance owed by Cronos Finanz Business School is the venue selected by Cronos Finanz Business School.
If the student is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship between the student and Cronos Finanz Business School is exclusively the registered office of Cronos Finanz Business School.
